When you visit our website https://cretelligent.com (the “Website”), and more generally, use any of our services (the “Services”, which include the Website), we appreciate that you are trusting us with your information. We take your privacy very seriously. In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it.

This privacy notice applies to all information collected through our Services, and any related services, sales, marketing or events, and serves as our notice at collection under California law when linked at or before the point of collection. It does not address personal information we collect from our employees, contractors, or job applicants, who receive a separate notice. Please read this privacy notice carefully as it will help you understand what we do with the information that we collect.

We collect information that you provide to us. We collect information that you voluntarily provide to us when you register on the Website, express interest in obtaining information about us or our products and Services, participate in activities on the Website or otherwise contact us.

Categories of Personal Information Under California Law

We do not collect the other categories of personal information enumerated in the CCPA (such as characteristics of protected classifications, biometric information, health information, or precise geolocation). We use and disclose sensitive personal information only for purposes permitted under CCPA regulations (authenticating accounts and maintaining security) and do not use it to infer characteristics about you; accordingly, no “Limit the Use of My Sensitive Personal Information” option is required.

4) WHO WILL YOUR INFORMATION BE SHARED WITH?

We share information with specific categories of vendors and platforms needed to provide our services, such as:

• PayPal, Authorize.Net, FreedomMerchants.com, Bill.com
• Facebook, LinkedIn (social/business networking)
• Amazon AWS (hosting)

Most of these companies act as our service providers under written contracts that restrict their use of your information to providing services to us. Our use of advertising and analytics cookies (such as Google Analytics, Facebook, and LinkedIn tools) may result in the disclosure of identifiers and internet activity to those platforms for cross-context behavioral advertising, which California law treats as “sharing” and may treat as a “sale” even though no money changes hands. We do not sell personal information for money. In the preceding 12 months, we have “shared” identifiers and internet or other network activity information with advertising networks and social media platforms. You can opt out at any time as described in Section 11.

We reserve the right to modify these service providers at any time.

5) COOKIES AND TRACKING

6) GOOGLE MAPS

We use Google Maps APIs for business location functionality, in accordance with Google’s policies.

7) HOW LONG DO WE KEEP YOUR INFORMATION?

We retain information only as long as necessary for the purposes described in this notice or as required by law. The retention criteria for each category of personal information are set out in the table in Section 1.

8) DO WE COLLECT INFORMATION FROM MINORS?

No, this website is not intended for use by children under 18, and we do not knowingly collect personal information from them. We do not knowingly sell or share the personal information of consumers under 16 years of age.

9) YOUR PRIVACY RIGHTS

We extend the following rights to all United States residents, whether or not the privacy law of your state requires it. For California residents, these rights arise under the California Consumer Privacy Act (CCPA) and include individuals whose information we collect in a business-to-business context; residents of other states may have similar rights under their state’s comprehensive privacy law:

• Right to know and access. You may request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties to whom we have disclosed, sold, or shared it. You may request information beyond the preceding 12 months for personal information collected on or after January 1, 2022.
• Right to delete. You may request that we delete personal information we have collected from you, subject to exceptions permitted by law.
• Right to correct. You may request that we correct inaccurate personal information we maintain about you.
• Right to opt out of sale, sharing, and targeted advertising. You may opt out of the “sale” or “sharing” of your personal information, including disclosures for targeted advertising, as described in Section 11. We do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers.
• Right to limit use of sensitive personal information. We use sensitive personal information only for purposes permitted by law (see Section 1), so no separate limit option is required.
• Right to non-discrimination. We will not discriminate against you for exercising any of these rights. We do not offer financial incentives in exchange for personal information.

How to submit a request. Email support@CREtelligent.com or call us toll-free at [TOLL-FREE NUMBER]. We will confirm receipt of your request within 10 business days and respond within 45 calendar days. If we require more time, we will notify you of the reason and may take up to 45 additional days.

Verification. We will verify your identity by matching the information you provide against information we maintain about you. If you hold an account with us, we may verify your identity through that account.

Authorized agents. You may designate an authorized agent to submit a request on your behalf. We will require proof of the agent’s authorization and may require you to verify your identity directly with us.

Appeals. If we decline to take action on your request, you may appeal our decision within 45 days of receiving it by emailing support@CREtelligent.com with the subject line “Privacy Appeal.” Within 45 days of receiving your appeal, we will inform you in writing of any action taken or not taken and the reasons for our decision. If your appeal is denied, you may contact the Attorney General of your state to submit a complaint.

10) DO-NOT-TRACK AND OPT-OUT PREFERENCE SIGNALS

Our Website does not currently respond to Do-Not-Track (DNT) browser signals. However, we do honor opt-out preference signals, including the Global Privacy Control (GPC). When your browser or extension transmits a GPC signal, we treat it as a valid request to opt out of the sale or sharing of personal information associated with that browser, and we will indicate that the signal has been processed.

11) CALIFORNIA AND OTHER US STATE PRIVACY NOTICE

This section supplements the rest of this privacy notice for California residents and describes opt-out mechanisms available to all US residents. The CCPA applies to the personal information of California residents, including business contacts such as the employees and representatives of our clients, prospects, and vendors.

Sale and sharing. We do not sell personal information for money. Our use of third-party advertising and analytics cookies may constitute “sharing” (and potentially “selling”) under the CCPA, as described in Section 4. California Civil Code Section 1798.83 permits California residents to request certain information regarding disclosure of personal information to third parties for those parties’ own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

12) UPDATES TO THIS NOTICE

We review this notice at least once every 12 months and may update it as needed to reflect changes in our practices or legal requirements. The updated notice will be posted with a revised “Last updated” date. If we make material changes, we will provide notice by email (if we have your email address) or by prominent notice on the Website before the changes take effect.
